GENERAL
- stage.private-yacht.com by Deep Blue Co., Ltd (hereafter Deep Blue), TAT number 34/03030, offers on the website stage.private-yacht.com boat tours in Thailand and arranges boat tours.
- By renting a boat or purchasing a tour you accept our Terms and Conditions defined below.
PRIVATE CHARTER
- The boat rental including all costs for meals and additional add-ons must be paid in full before the start of the cruise. Payments are accepted in cash, by bank transfer, or credit card. Payment by electronic methods is subject to a processing fee. See the Payment Processing Fees section below for details.
- Boat rentals from Deep Blue always include fuel, licensed Captain and crew, safety and first aid equipment, accident insurance.
- Furthermore the boat rental includes all the services mentioned on the website or during the booking process (only written agreements are binding). Often more, but never less. If certain services offered are not used voluntarily or if services are expected that go beyond the agreed service, no claim for reimbursement can be derived from this. This also applies to self-inflicted delays or tour cancellations due to rule-breaking behavior.
- Waiting time is always paid time: If the customer does not start on time and has not made prior arrangements with us, the lost tour time is non-refundable. An extension of the tour beyond the previously fixed time is possible only by further agreement and probably additional surcharge. Please keep in mind, that most boats can't cruise after sunset. In case of reduced tour time the captain may decide to change the planned itinerary depending on the delay.
- Due to their tight schedules taxis that we have ordered for the transfer usually wait a maximum of 15 minutes. If they need to cancel the transfer order, they will nevertheless charge the full amount and the customer will need to arrange another transport on your own.
- It is not allowed to sublet the boat to a third party
EXECUTION
- Deep Blue reserves the right to change routes and pickup and drop off locations if weather conditions or other legitimate reasons so require.
- The captain is always responsible and has the final decision-making power. Safety comes first.
- In the event of misconduct that endangers safety or property damage, the captain has the right to interrupt the voyage or end it immediately. According to Thai law, persons under the influence of alcohol/drugs will be refused boarding. In such a case, the customer's payment obligation remains.
- Passengers must follow all crew instructions immediately and without delay. This also applies to putting on life jackets. Outside of areas controlled by the Marine Department, wearing supplied life jackets is recommended at all times.
- Access to ships and jetties can be refused without reason if this is deemed necessary by the crew, e.g. with regard to capacity, safety, public order or the imminent risk of damage or nuisance.
- The passenger is expected to take care of the environment and not to dispose waste in the water. All personal consumptions and the associated waste should be disposed in the appropriate bins available on the boat.
- In the event of manifest errors in published information, Deep Blue reserves the right to correct such errors without liability. These terms and conditions are governed by Thai law. Any disputes shall be subject to the jurisdiction of the competent courts of Phuket, Thailand.
LIABILITY
- Deep Blue is not liable for damage and/or loss of passenger property. Passengers take all their belongings on board at their own risk.
- All tours booked with Deep Blue are insured against boat accidents. Beside of that, Deep Blue is not liable for any personal injury or property damage of any kind, regardless of cause, before, during or as a result of the trip. This does not apply to damage caused by intent or gross negligence on the part of Deep Blue. The statutory compensation is limited to the price of the boat rental for the respective trip.
- Deep Blue shall not be liable for any damage to persons or property of passengers caused by stepping on or boarding a jetty or boat. Passengers enter these areas entirely at their own risk.
- Guests are liable for any damage they cause to the items/goods used by Deep Blue or third parties.
- All shore and water activities organized by Deep Blue take place at your own risk.
- Children are the responsibility of parents. Children under the age of 4 are required to sit on their parents' laps.
- Should Deep Blue not be able to comply with their obligations due to force majeure, there is no entitlement to restitution or compensation, but a refund of amounts paid will be issued in accordance with the Payment Processing Fees section below.
DEPOSIT AND PAYMENT IN FULL
Once we have received a deposit of at least 50% of the total price (including taxes) for the offer you have approved, we can confirm the booking.
The balance is due no later than 7 days before departure, in some cases 14 days before departure (depending on the logistics and the yacht).
If you prefer to be on the safe side and pay the balance at boarding, please pay in cash in Thai Baht. Foreign currencies only by prior arrangement.
PAYMENT PROCESSING FEES
When paying by credit card, PayPal, or other electronic payment methods, a payment processing fee is charged to cover costs imposed by third-party payment providers. This fee is non-refundable in all cases, including cancellations initiated by Deep Blue due to weather or technical reasons. Payment processing fees are charged by independent financial institutions and cannot be recovered by Deep Blue once a transaction has been processed.
Customers who wish to avoid payment processing fees may pay by bank transfer or wise.com (no fee), or in cash in Thai Baht at boarding (balance only).
CANCELLATION BY DEEP BLUE (stage.private-yacht.com)
- If it is not possible to safely complete the booked tour due to a technical problem or dangerous weather conditions (predicted by the Marine Department Thailand), we will offer you an alternative date or a full refund of the charter price paid. Please note: payment processing fees (credit card, PayPal, etc.) are non-refundable as these costs are incurred by third-party providers regardless of whether the tour takes place. See Payment Processing Fees above.
- As an alternative to a cash refund, customers may opt for a credit voucher for the full charter amount (including the payment processing fee), valid for 12 months from the original booking date. Vouchers can be applied to any charter operated by Deep Blue.
CANCELLATIONS BY CUSTOMER
The purpose of the deposit is to ensure that both parties consider the booking to be binding.
Therefore, in the event of a unilateral termination of the contract (cancellation) by the customer, not in all cases a refund of the deposit is possible. This depends in particular on the booking lead times and the possibility of compensating for the loss through new bookings:
Speedboat:
- Cancellation up to 1 month before departure: full refund *
- Cancellation up to 3 days before departure: 25% refund *
Motor Yacht / Sailing Yacht / Power Catamaran:
- Cancellation up to 3 months before departure: full refund *
- Cancellation up to 1 month before departure: 25% refund *
(less all payments for booked third-party services)
Party boat / Super Yacht:
- A refund of payments for Party-Boat and Super Yacht rental is generally not possible, as a loss of sales cannot be compensated for within several weeks under normal conditions.
- Payments for booked services from third-party providers**:
- Cancellation up to 3 months before departure: full refund
- Cancellation up to 1 month before departure: 25% refund
Travel cancellation insurance
Since extraordinary incidents of force majeure (such events include, for example, personal illness or pandemic, closure of borders or airports, war or riots, etc.) can make a cancellation unavoidable, but have the same effect as a normal cancellation, we recommend taking out travel cancellation insurance. Or check whether third-party services are covered by the cancellation insurance that is already included in your flight ticket.
Since we issue official invoices, recognition has never been a problem.
